For those of you who do not get the reference right off the bat, Dr. Raymond Cocteau was the benevolent dictator in the 1993 Sylvester Stallone movie, Demolition Man. In this movie, the future is a Utopian version of itself. There is no crime, there are no STDs, no war, etc. Everyone is happy, thin, and under the total control of the government in accordance with the wishes of Dr. Cocteau. There are no cigarettes, those are bad for you. To quote Sandra Bullock’s character “Ah, smoking is not good for you, and it’s been deemed that anything not good for you is bad; hence illegal. Alcohol, caffeine, contact sports, meat….” You get the picture. Welcome to the United States of America in 2013 except that we have President Barack Hussein Obama as OUR benevolent leader.
No, I am not taking this too far. Yesterday the President gave an hour-long speech over the healthcare problems, the failed website, the loss of coverage for millions of people, and his lie about if you like your plan you could keep it. In that speech he announced that he is making changes under his law to give insurance companies the option to keep offering people plans that don’t meet the minimum requirement under the law and were subject to cancellation. He said, “This fix won’t solve every problem for every person, but it’s going to help a lot of people.” He is going to do this under his use of prosecutorial discretion. A tidbit for you, prosecutorial discretion has nothing to do with the enforcement of laws. Instead, under that the president may decide who to, and not to, prosecute federally. It does not give him the power to decide which part of laws that he will or will not order enforced. This is unconstitutional. He is making up his own laws and then setting the government out to enforce them in accordance with his will.
The Take Care Clause of the Constitution forbids that action. Article II, Section 3 of the Constitution says, “he shall take care that the Laws be faithfully executed.” The Take Care Clause was written into the Constitution to abolish “Royal Prerogative” under the crown. It was the power of the King to disregard or suspend acts of Parliament. The king had no power to make laws, but he could choose not to enforce laws that Parliament enacted. The president has no power to make laws, nor can he choose what to enforce, except when he does such as with immigration deportations, DOMA, and Obamacare. The president, by virtue of his swearing-in, is bound to uphold the Constitution, and yet he does as he chooses. If this were Bush, the media would be excoriating him, the Congress would be starting impeachment proceedings, and we would all be standing by waiting for the guilty verdict to come down. But not with our benevolent leader.
But these things aren’t that intrusive? You still don’t see where I am going with this. It is not one thing, its a hundred things, a myriad of seemingly unconnected things that point to a systemic take over of our daily lives when considered as a whole. How about the Administration’s attack on trans fats? Remember anything that isn’t good for you is illegal. The FDA is taking the first step towards banning trans fat. But America has been warned of the dangers of trans fats, and the consumer can now make an informed and voluntary choices as to whether or not to consume said fat. Trans fats are safe, they just aren’t healthy and this ban could set the type of precedent that would allow the FDA to eliminate other ingredients that are safe but possibly not as healthy in the government’s view as other options. Therefore, they are going to dictate what freedoms you have the right to decide between.
This cycle will continue until you wake up one morning and in the words of Denis Leary, again from Demolition Man, “I’ve seen the future, you know what it is. A 47 year-old virgin sitting in his pajamas, drinking a broccoli shake, singing “I’m an Oscar-Meyer wiener.”
